Terms of Service

1. Acceptance of terms

By inviting, using or interacting with Roody (the "Bot") on Discord, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these terms, do not use the Bot.

Important

These terms constitute a legally binding agreement between you and Roody. By using our services you confirm that you are at least 14 years old if you live in Spain or the European Union, or the minimum age required by the law of your country if that is higher. Below that age, consent from a parent or guardian is required. If you are a minor, you also need that authorisation to purchase any paid plan.

2. Service description

2.1 What is Roody?

Roody is a Discord bot with a web dashboard that provides:

Moderation: automatic filters, commands and user management.
Utility: tools for managing your server.
Entertainment: fun commands and mini-games.
Economy: a virtual currency system and shop.
Levels: an XP and ranks system.
Tickets: a support system for your server.

2.2 Service availability

We strive to keep the Bot available 24/7, but we do not guarantee 100% uptime. The service may be temporarily unavailable due to:

Scheduled maintenance.
System updates.
Unforeseen technical issues.
Disruptions in Discord's services.

3. Acceptable use

3.1 Permitted behaviour

Managing and moderating your Discord server.
Providing entertainment to the members of your server.
Improving the experience of your community's users.
Setting up custom systems for your server.

3.2 Prohibited behaviour

The following is strictly prohibited

Spam or abuse: using the Bot to send spam or unwanted content.
Circumventing limits: attempting to bypass rate or usage limits.
Reverse engineering: attempting to decompile, decode or modify the Bot.
Illegal content: distributing illegal or harmful content with the Bot.
Violating Discord's ToS: using the Bot in breach of Discord's terms.
Impersonation: pretending to be the Roody team.
Exploiting vulnerabilities: exploiting bugs or flaws in the Bot.

4. Accounts and servers

4.1 Server responsibility

As the owner or administrator of a server:

You are responsible for configuring the Bot appropriately.
You must ensure that its use complies with these terms.
You are responsible for the actions of your server's members.
You must maintain the appropriate permissions for the Bot to work.

4.2 Suspension of services

We reserve the right to suspend or terminate the service for any server that:

Violates these terms.
Uses the Bot for illegal activities.
Causes harm to our systems or to other users.
Is reported for serious violations.

5. Privacy and data protection

Use of the Bot is subject to our Privacy Policy, which forms an integral part of these terms.

5.1 Data we collect

To operate the Bot we collect only:

Discord user and server IDs.
Server-specific settings.
Usage data needed for the Bot's features.
Basic logs for debugging and improvements.

5.2 Your rights

You have the right to request the deletion of, access to, rectification of, or portability of your data. Details in the privacy policy.

6. Paid plans and purchases

6.1 What you are buying

Roody can be used free of charge. We also offer paid plans (Roody Pro and Roody Team) that unlock extra modules and higher limits. The current detail of each plan and its price is on the pricing page, which forms part of these terms.

Prices are shown in euros. The checkout itself states whether the amount includes taxes and which ones apply in your country.

6.2 How the purchase works

You pick a plan on the pricing page and sign in with your Discord account.
We send you to our payment provider, where you enter your billing and card details. We never see or store your card details.
Once the payment is confirmed you receive a receipt by email and the plan is activated on your account.

The contract is formed when we confirm the payment. The language of the contract is Spanish or English, whichever you have selected.

6.3 Renewal and cancellation

Subscriptions renew automatically at the end of each period (monthly or yearly) for the same amount, unless you cancel beforehand.
You can cancel whenever you like from the dashboard or by writing to [email protected]. Cancellation takes effect at the end of the period you already paid for: you keep the plan until then and are not charged again.
One-off memberships do not renew and create no recurring charges.
If we change a plan's price we will tell you at least 30 days in advance, and you can cancel before it takes effect.

6.4 Right of withdrawal

You have 14 calendar days to withdraw, without giving any reason, counted from the purchase (articles 102 and following of the Spanish consolidated Consumer Protection Act).

To exercise it, just tell us by any unambiguous means, for example by writing to [email protected]. You may use the model withdrawal form in Annex A of that Act, but you do not have to. We will refund you using the same payment method within 14 days of receiving your notice.

Exception for digital content. Because the plan is activated immediately, the checkout asks you to expressly agree that performance begins during the withdrawal period and to acknowledge that, by doing so, you lose that right once the service has been fully performed (art. 103(m)). If you do not give that consent, the plan is activated once the 14 days have passed.

6.5 Failed payments and refunds

If a charge is declined, the plan may be suspended until the situation is resolved.
Outside the right of withdrawal, if the service does not work as contracted you are entitled to have it brought into conformity and, where that is not possible, to a price reduction or to terminate the contract.

6.6 Complaints

You can send any complaint to [email protected]. If you are a consumer resident in the European Union, you can also use the European Commission's online dispute resolution platform: ec.europa.eu/consumers/odr.

7. Warranty limitations and disclaimers

7.1 Disclaimer of warranties

The Bot is provided "as is" without warranties of any kind. We do not guarantee that:

The service will be available without interruption.
Every feature will work perfectly at all times.
The Bot will meet all of your specific requirements.
Errors will be corrected immediately.

7.2 Limitation of liability

In no event shall we be liable for indirect, incidental, special or consequential damages, including but not limited to:

Loss of data or information.
Loss of profits or revenue.
Business interruption.
Damages arising from the use of, or inability to use, the service.

8. Intellectual property

8.1 Roody's rights

All rights, title and interest in the Bot, including but not limited to:

Source code and algorithms.
Design and user interface.
Documentation and help materials.
Trademarks and logos.

are the exclusive property of Roody and are protected by intellectual property laws.

8.2 Licence of use

We grant you a limited, non-exclusive, non-transferable and revocable licence to use the Bot solely in accordance with these terms.

9. Updates and modifications

9.1 Bot updates

We reserve the right to:

Update, modify or discontinue features of the Bot.
Change how the Bot works.
Add new features or remove existing ones.
Improve security and performance.

9.2 Changes to the terms

We may modify these terms at any time. When we do:

We will publish the new terms on this page.
We will notify significant changes from the dashboard.
Changes take effect once published.
Continued use of the Bot constitutes acceptance of the new terms.

10. Termination

10.1 Termination by you

By removing the Bot from your server.
By ceasing to use the Bot's commands.
By requesting the deletion of your data.

10.2 Termination by us

We may suspend or terminate your access to the Bot if you:

Violate these terms.
Use the Bot in a way that harms others.
Engage in illegal activities.
Abuse the service or attempt to damage our systems.

10.3 Effect of termination

Your right to use the Bot will cease immediately.
We may delete your data in accordance with our retention policy.
Sections that by their nature should survive will remain in force.

11. Governing law and dispute resolution

11.1 Governing law

These terms are governed by the laws of Spain, without giving effect to any conflict-of-laws principles.

11.2 Dispute resolution

Direct contact: first try to resolve the dispute by contacting us directly.
Mediation: if it cannot be resolved directly, we will seek mediation.
Jurisdiction: any legal action will take place in the courts of Spain.
